The Residential Tenancies Act (RTA) provides comprehensive protections for Ontario tenants. These rights cannot be waived or signed away, even if included in a lease agreement. Understanding your rights helps ensure a fair and safe tenancy.

Right to Quiet Enjoyment

Tenants have the right to live in their rental unit without unreasonable disturbances from the landlord or other tenants.

Privacy Rights

Landlords must provide 24 hours written notice before entering, except in emergencies. Entry must be between 8am-8pm.

Right to Proper Notice

Landlords must follow strict notice requirements for rent increases, renovations, or termination of tenancy.

Protection from Illegal Eviction

Only the Landlord and Tenant Board can order evictions. Self-help evictions are illegal and subject to penalties.

Landlord Obligations

Under the RTA, landlords must fulfill these responsibilities:

  • Maintain the rental unit in good repair and fit for habitation
  • Comply with health, safety, and maintenance standards
  • Provide vital services (heat, water, electricity)
  • Make repairs within a reasonable time period
  • Follow proper procedures for rent increases (90 days notice with N1 form)
  • Not discriminate based on protected grounds under Human Rights Code
  • Provide receipts for rent payments upon request
  • Return rent deposit with interest when tenancy ends

Tenant Responsibilities

Tenants also have important obligations under the RTA:

  • Pay rent in full and on time
  • Keep the rental unit clean and in reasonable condition
  • Repair damage caused by themselves or guests
  • Not disturb other tenants or the landlord
  • Follow rules in the lease (if reasonable and legal)
  • Allow landlord access with proper notice
  • Notify landlord of maintenance issues promptly
  • Use the rental unit only for residential purposes
